Acceptance of terms
These Terms of Use (“Terms”) constitute a legally binding agreement between you and BRASI Ltd (“BRASI”, “we”, “us”, or “our”) governing your access to and use of the BRASI platform, including all associated services, features, and content (collectively, the “Platform”).
By accessing or using the Platform in any way — including browsing, creating an account, submitting content, or engaging with a support provider — you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.
If you do not agree
If you do not agree to these Terms, you must not use the Platform. You may discontinue use at any time and request deletion of your account and all associated data.
BRASI reserves the right to modify these Terms at any time. Where changes are material, we will provide at least 30 days' notice via a platform notice and, where an email address is registered, by email. Continued use of the Platform after the effective date of revised Terms constitutes your acceptance of those changes.
Eligibility
The Platform is intended for users aged 16 and over. If you are under 16, you may only use the Platform with the involvement of a parent, guardian, or responsible adult. By using the Platform you represent that you meet this eligibility requirement.
Platform purpose
BRASI is a trauma-informed, privacy-first digital platform designed to support survivors and students in documenting their experiences, processing difficult events, and accessing verified wellbeing and support services at their own pace and on their own terms.
What BRASI is
- A private, encrypted journaling tool for personal documentation
- A curated directory of manually verified therapists, counsellors, legal advisors, ISVAs, and peer support workers
- A secure, anonymous messaging pathway to verified support providers
- A wellbeing infrastructure tool for institutional partners, providing aggregated, anonymised engagement insights
- A trauma-informed digital resource designed to lower barriers to support access
Critical legal positioning — please read
- BRASI is not a law enforcement platform. Using BRASI does not constitute making a formal complaint, report, or allegation to any authority.
- BRASI does not investigate, adjudicate, or make determinations about the truth or falsity of any account documented on the Platform.
- BRASI does not determine guilt, liability, or culpability of any individual or organisation.
- BRASI is not a substitute for emergency services. If you or someone else is in immediate danger, contact emergency services (999 in the UK).
- BRASI does not provide medical, psychiatric, legal, or clinical advice. Support providers listed on the platform are independent professionals.
What BRASI is not
- A formal complaints mechanism or grievance procedure
- A replacement for institutional safeguarding processes
- A crisis intervention or emergency mental health service
- A legal advice or representation service
- A reporting tool to any regulatory, governmental, or law enforcement body
Anonymous usage
You have the right to remain anonymous
BRASI is designed so that you can access the full core platform experience — including journaling and browsing verified providers — without disclosing your identity. This is not a reduced or limited mode. It is the complete platform.
Anonymous usage in practice
- You may create an account using only a private alias. A real name is never required.
- No institutional email, student number, or government identification is required at any stage.
- Your institution — even if it is an institutional partner of BRASI — cannot determine whether you have an account, access your usage history, or identify you from your usage.
- You may contact verified support providers anonymously. Providers receive only the information you explicitly choose to share.
- Nothing in these Terms requires you to disclose your identity to BRASI or to any other party.
Responsibility for anonymous content
While BRASI supports and enables anonymous use, these Terms apply to all users regardless of whether they have identified themselves. Anonymous use does not exempt a user from the obligations in these Terms, including the prohibitions in Section 8. Where BRASI becomes aware of serious misuse, we reserve the right to take appropriate action including account restriction or, where legally required, cooperation with lawful demands from appropriate authorities.
User responsibilities
As a user of the BRASI Platform, you agree to use the Platform only for its intended purpose and in a manner consistent with these Terms, applicable law, and the wellbeing of other users and support providers.
You agree to
- Use the Platform only for lawful purposes and in good faith
- Keep your account credentials secure and not share them with others
- Notify BRASI promptly if you become aware of any unauthorised access to your account
- Provide accurate information where you choose to share information (e.g. with a support provider)
- Respect the privacy, anonymity, and dignity of all other users
- Follow any guidelines or protocols provided by support providers during engagements
Account security
You are responsible for maintaining the security of your account credentials. BRASI will never ask you to share your password by email, chat, or any other channel. If you suspect your account has been compromised, contact us immediately at hello@brasi.io.
User-generated content
Content you create on BRASI — including journal entries, messages, and any uploaded documents — belongs to you. You grant BRASI a limited, non-exclusive licence to store and process that content solely for the purpose of providing the Platform services to you. This licence does not permit BRASI to share, sell, or use your content for any other purpose. See Section 9 (Intellectual Property) for full details.
Institutional use
Institutions — including universities, colleges, student unions, and corporate organisations — that partner with BRASI (“Institutional Partners”) are subject to a separate Partnership Agreement in addition to these Terms. In the event of any conflict between these Terms and a Partnership Agreement, the Partnership Agreement shall prevail in respect of the institutional relationship.
Institutions must not
- Attempt to identify individual students or users through BRASI platform data, analytics, or any other means
- Use BRASI as a formal reporting, disciplinary, or complaints mechanism
- Represent BRASI to students as a replacement for institutional safeguarding, counselling, or support services
- Use aggregate platform insights to make decisions about specific individuals
- Share BRASI institutional dashboard access with third parties without prior written consent from BRASI
- Access or attempt to access any data beyond the anonymised aggregate dashboard provided
Institutional partner obligations
- Maintain independent, compliant safeguarding policies and procedures that meet applicable legal and regulatory requirements
- Designate a named safeguarding lead responsible for the partnership, and keep BRASI informed of any changes to this contact
- Provide accurate information about the institution during the partnership onboarding process
- Inform students clearly and accurately about what BRASI is, including that it is a supplementary resource and not a reporting mechanism
- Renew the Partnership Agreement annually and confirm ongoing compliance with BRASI's institutional access terms
Student privacy is structurally protected
Even if an institution were to attempt to access individual student data in violation of these Terms, BRASI's technical architecture makes this impossible. Individual student access restrictions are enforced at the database and API level — they cannot be overridden by any administrative action or contractual arrangement.
Service provider conduct
Service providers listed on BRASI — including therapists, counsellors, ISVAs, legal advisors, and peer support workers — are independent professionals who have completed BRASI's verification process. They are not employees or agents of BRASI.
Providers must
- Maintain current professional registration with the relevant licensing body throughout the period of their BRASI listing
- Hold a current enhanced DBS check or equivalent, and notify BRASI if this status changes
- Practice in accordance with trauma-informed principles at all times when engaging with BRASI users
- Respect and maintain the anonymity of all users, unless the user has explicitly and voluntarily disclosed their identity
- Notify BRASI promptly of any change to their professional status, registration, or qualifications
- Not share user information, conversation content, or any identifying data with any third party, including the user's institution, without the user's explicit written consent
- Adhere to their professional body's code of ethics and conduct standards throughout all BRASI engagements
Providers must not
- Attempt to identify, contact, or pursue any user outside the BRASI platform without explicit user consent
- Share user data with any institution, employer, or third party in violation of these Terms or applicable law
- Misrepresent their qualifications, experience, or areas of expertise in their platform listing
- Use the BRASI platform for commercial purposes beyond providing the services for which they are verified
- Engage in any conduct that constitutes harassment, discrimination, coercion, or abuse of any user
Reporting provider concerns
If you have concerns about the conduct of a provider, please contact us at hello@brasi.io. We take all concerns seriously and will investigate promptly. Provider listings may be suspended pending investigation.
Privacy & confidentiality
Your privacy is constitutionally protected within BRASI
BRASI's commitment to user privacy goes beyond policy compliance. It is enforced at every layer of our technical infrastructure. Our full Privacy Policy explains this in detail and is incorporated into these Terms by reference.
Confidentiality of journal content
Your journal entries are private by default. They are encrypted at rest and accessible only to you. BRASI staff cannot read your journal entries. Your institution cannot access your journal entries. No third party can access your journal entries except through a lawful court order directed at BRASI, which we will challenge where legally permitted and notify you of in advance where lawfully able to do so.
Confidentiality of support conversations
Conversations between you and a support provider are confidential between you and that provider. BRASI does not monitor, log, or review conversation content. Providers are bound by their professional confidentiality obligations and by these Terms. Shared data remains under your control — see the Privacy Policy for full details on your rights.
Safeguarding exceptions
Support providers on BRASI remain subject to their professional mandatory reporting obligations. Where a provider is legally required to report a safeguarding concern to an appropriate authority, they may do so in accordance with their professional duties. This is independent of BRASI and governed by the provider's own professional and legal obligations. BRASI itself does not operate as a mandatory reporter.
| Data type | Who can access it |
|---|---|
| Your journal entries | You only. Not BRASI staff, not your institution, not any third party. |
| Support conversations | You and the provider you are conversing with. Not BRASI staff, not your institution. |
| Your identity / alias | You only, unless you choose to share it with a provider. |
| Platform usage (aggregate) | Your institution receives only anonymised, aggregate data — never individual usage. |
| Verification data (providers) | BRASI staff for vetting purposes only. Not shared with users or institutions. |
Prohibited conduct
The following conduct is strictly prohibited on the BRASI Platform. Violation of these prohibitions may result in immediate account suspension, permanent termination, and, where legally required or appropriate, referral to the relevant authorities.
Privacy violations
- Attempting to identify, de-anonymise, or expose the identity of any other user of the Platform
- Sharing, publishing, or transmitting any information that could identify another user without their explicit consent
- Attempting to circumvent, reverse-engineer, or bypass BRASI's privacy or encryption systems
- Using any automated tool, script, or bot to scrape user data, content, or platform information
Harmful and abusive conduct
- Harassing, threatening, intimidating, or abusing any user, provider, or BRASI staff member
- Uploading, sharing, or transmitting any content that is unlawful, defamatory, obscene, or abusive
- Impersonating any person or organisation, including misrepresenting professional qualifications or credentials
- Using the Platform to contact or target individuals in connection with ongoing legal proceedings in a manner that could constitute witness intimidation or contempt
Platform misuse
- Using the Platform for any commercial purpose not expressly authorised by BRASI in writing
- Uploading or transmitting malware, viruses, or any other harmful or disruptive code
- Attempting to gain unauthorised access to any part of the Platform, its infrastructure, or other users' accounts
- Using the Platform in any way that could damage, disable, overburden, or impair its functionality
- Misrepresenting the nature of BRASI to students, vulnerable individuals, or third parties — including representing it as a formal reporting mechanism
Zero tolerance for re-traumatisation
Any conduct that could cause harm, re-traumatisation, or distress to a survivor using this platform is taken with the utmost seriousness. BRASI reserves the right to act swiftly and without prior warning in response to such conduct.
Intellectual property
BRASI platform IP
The BRASI Platform — including its design, interface, code, brand assets, trade marks, logos, text, and functionality — is owned by or licensed to BRASI Ltd. Nothing in these Terms grants you any right, title, or interest in BRASI's intellectual property beyond the limited licence to use the Platform as described in these Terms.
You may not copy, reproduce, distribute, modify, create derivative works from, reverse engineer, decompile, or otherwise exploit any part of the BRASI Platform without our prior written consent.
Your content
Your content belongs to you
All content you create on BRASI — including journal entries, messages, notes, and any uploaded documents — remains your property. BRASI does not claim ownership of any user-generated content.
By submitting content to the Platform, you grant BRASI a limited, non-exclusive, royalty-free licence to store, process, and transmit that content solely for the purpose of providing the Platform services to you. This licence:
- Does not permit BRASI to share your content with any third party, except as required to provide the service (e.g. transmitting a message to a provider you have chosen to contact)
- Does not permit BRASI to use your content for training AI or machine learning systems
- Does not permit BRASI to use your content for research, marketing, or any commercial purpose
- Terminates automatically when you delete your content or account
Feedback and suggestions
If you provide feedback or suggestions about the Platform, you grant BRASI an unrestricted, royalty-free licence to use that feedback for any purpose. Feedback is not considered confidential and does not create any obligation on BRASI to implement or compensate for it.
Disclaimers
Emergency situations
BRASI is not a crisis or emergency service. If you or someone else is in immediate danger or requires urgent mental health support, please contact emergency services (999 in the UK) or a crisis line such as Samaritans (116 123) immediately. BRASI cannot provide real-time crisis response.
No professional advice
Nothing on the BRASI Platform constitutes medical, psychiatric, psychological, legal, or any other form of professional advice. Support providers are independent professionals — any guidance or information they provide reflects their individual professional judgement and is not endorsed or warranted by BRASI.
Provider quality
BRASI verifies that providers hold the credentials they present at the time of verification. We do not guarantee the quality, suitability, or outcome of any support engagement. BRASI is not liable for the advice, conduct, or omissions of any listed support provider, who is an independent professional and not an employee or agent of BRASI.
Platform availability
BRASI provides the Platform on an “as available” basis. We do not guarantee uninterrupted, error-free access. We reserve the right to suspend, modify, or discontinue any aspect of the Platform for maintenance, security, or operational reasons, with reasonable notice where practicable.
Third-party links and resources
The Platform may contain links to third-party websites, resources, or services. These are provided for information only. BRASI does not endorse, control, or take responsibility for the content or practices of any third-party site or service.
Limitation of liability
To the fullest extent permitted by applicable law, BRASI excludes all liability for any loss or damage — including indirect, incidental, consequential, or punitive damages — arising from or in connection with your use of or inability to use the Platform, including but not limited to:
- Loss of data or content (other than as a result of BRASI's direct negligence)
- Loss of profits, revenue, business, or opportunity
- Harm resulting from the advice, conduct, or omissions of any independent support provider
- Interruptions to platform availability or access
- Unauthorised access to your account arising from your failure to maintain account security
Cap on liability
Where BRASI is found to be liable, our total aggregate liability to you in respect of all claims arising under or in connection with these Terms shall not exceed the greater of: (a) the total fees paid by you to BRASI in the 12 months preceding the claim, or (b) £100.
Exceptions
Nothing in these Terms limits or excludes BRASI's liability for: (a) death or personal injury caused by BRASI's negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited by applicable law.
Applicable law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Suspension & termination
Your right to close your account
You may close your BRASI account at any time by accessing your account settings or contacting us at hello@brasi.io. On closure, your personal data will be permanently deleted within 72 hours. See our Privacy Policy for full details on data deletion.
BRASI's right to suspend or terminate
BRASI reserves the right to suspend or permanently terminate your access to the Platform, with or without prior notice, if we have reasonable grounds to believe that:
- You have materially breached any provision of these Terms
- Your use of the Platform poses a risk to the safety or privacy of other users
- You have provided materially false or misleading information to BRASI
- Continued access would violate applicable law or create legal liability for BRASI
- A verified support provider has breached the provider conduct obligations in Section 6
Appeals process
If your account is suspended or terminated by BRASI and you believe this to be in error, you may submit an appeal within 30 days to hello@brasi.io with the subject line “Account Appeal”. We will review all appeals and respond within 10 working days.
Effect of termination
On termination, your access to the Platform ceases immediately. Provisions of these Terms that by their nature should survive — including Section 9 (Intellectual Property), Section 10 (Disclaimers), Section 11 (Limitation of Liability), and Section 13 (Contact) — continue in full force after termination.
Institutional partner termination
BRASI may suspend or terminate an institutional partnership with 30 days' written notice where the institution has materially breached these Terms or the Partnership Agreement. Termination of an institutional partnership does not affect the accounts or data of individual platform users associated with that institution.
